Rep. Calvert, along with three House colleagues, sent a letter to Attorney General Merrick Garland demanding an explanation for the drop in prosecutions of individuals caught in the U.S. after prior deportation. Calvert expressed his concerns, stating, “When it comes to the Biden Administration’s application of the law, Americans deserve answers.” He criticized the decrease in prosecutions, highlighting the inconsistency with the rising numbers of illegal border crossings.

The decrease in prosecutions under 8 U.S. Code Section 1326, a felony for reentering the U.S. without permission after deportation, has raised eyebrows. Calvert emphasized the importance of enforcing federal laws and criticized the lack of enforcement by the court system, attributing it to President Biden's open-border policies.

The Central District of California saw a significant decline in prosecutions under 8 USC 1326(a), with only five cases in 2023 compared to 188 cases in 2018. Despite 2.5 million illegal border crossings in 2023, the number of prosecutions has drastically decreased, signaling a concerning trend in the enforcement of immigration laws.
